In consideration of being allowed to participate in non-motorized water sport events and activities, for myself and minor children for whom I am parent, legal guardian or otherwise responsible, and for my heirs, assigns, personal representatives and successors (1) hereby release, waive, discharge and covenant not to sue or hold liable the Lakes Bay Recreation Association and The New Jersey Conservation Foundation, their officers, steering committees, their Board of Directors, their agents and members, jointly and severally, all for the purposes herein referred to as RELEASES, from all loss or damage, and any claim or demands, therefore, on account of injury to the person or property, or resulting in death, whether caused by the negligence of RELEASES or otherwise while for any purpose participating in any event or activity; (2) hereby agree to indemnify and save and hold harmless the RELEASES from any loss, liability, damage, or cost they may incur due to my presence and participation during any activity and whether caused by the negligence of RELEASES or otherwise; and (3) hereby assume full responsibility for any rise, due to my presence and participation and fault, of bodily damage, death or property damage due to negligence of RELEASES or otherwise while participating or for any other purpose while engaged in such activities. I expressly agree that the foregoing RELEASE, WAIVER, AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the laws of the state, states, or countries in which the activity is conducted and that if any portion thereof is held invalid, it is agreed that the balance of the agreement shall continue in full legal force and effect. I have read and voluntarily signed this RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT which shall remain in full legal force and effect until such time that I notify the Lakes Bay Recreation Association in writing that this agreement is voided and such notification is acknowledged by the Lakes Bay Recreation Association.
